By using this website, you signify your full acceptance of all of the policy documented below. If you do not agree to this policy, please do not use our website or make a booking at our skin clinic. Your continued use of the website following the posting of any changes to this policy will be deemed your acceptance of those changes.


 

PRIVACY AND COOKIES

DATA PROTECTION
The confidentiality of your information is of great importance to the Lumaesthetic Cinic (hereafter referred to as 'the Clinic'). The Clinic fully complies with Data Protection Legislation and Medical Confidentiality Guidelines. Information submitted over this website is normally unprotected until it reaches us. Users are requested not to send confidential details, credit card numbers, or sensitive information via unencrypted email, unless specifically requested.

 

USE OF INFORMATION
We do not collect information about individuals, except where this is specifically stated and provided with your knowledge. We do collect non-specific visitor information. This information is related to your browser and operating system and does not include any personal details. We also use ‘cookies’ which are alphanumeric identifiers that are stored by your web browser on your computer’s hard-drive that enable our system to recognise you when you visit the site. This helps us track basic visitor information in order that we can better tailor the site to our visitors’ needs. Most web browsers automatically accept cookies but you can disable this function by changing your browser settings if you so wish. We do not pass on any personal details or personally identifiable information without your specific consent.


 

FULL TERMS AND CONDITIONS

  1. PRODUCTS
    1.1 Due to the nature of the health or skin products, we will not be able to provide refunds for opened items, except in the event of a clinically significant adverse reaction.
    1.2 In the event of an adverse reaction, we will advise on an alternative product, which may be provided at no extra cost as a replacement for the product causing the reaction, at the company’s discretion.
  1. TREATMENTS
    2.1 All treatments at the Clinic will be performed by fully qualified practitioners who have received training in the procedures.
    2.2 We endeavour to adhere to your clinic appointment times. However, there may be delays to your appointment due to clinical or administrative reasons. We will not have any liability in such an event other than to offer an alternative treatment time.
    2.3 Prior to undergoing any treatment, you will have a full consultation with one of our team and will be asked to sign the consultation form to confirm your medical history and any pertinent information discussed. You will also be asked to sign and print an informed consent form. If at any time the information previously provided becomes updated or inaccurate, you must inform us as soon as possible and before any further treatments.
    2.4 We reserve the right to refuse provision of any part of a treatment. This is usually, but not exclusively, due to clinical reasons. We will not be liable to you for any loss in the case of such cancellations.
    2.5 All treatments, medications and procedures (major or minor) have a risk of adverse events. You will be fully counselled for clinically significant risks as part of the informed consent prior to any procedure or treatment. By signing the consent form, you are acknowledging the above amongst other details of the procedure. We will always endeavour to perform treatments with good skill and care. We will not be liable for any losses due to a recognised adverse event as long as the trained practitioner performed the procedure within good clinical practice.
    2.6 In the unlikely event that there is any problem with your treatment or experience with the Clinic, you are advised to contact us directly and in a timely manner to help resolve matters.
  1. NON-ATTENDANCE AND CANCELLATION
    3.1 If you do not attend a booked treatment without letting us know in advance then you will be responsible for either a consultation fee of £25 or not be offered another appointment, or both. The company has the final decision on the outcome.
    3.2 Credit/Debit card details may be taken at the time of booking to secure your appointment slot. No charges are taken at all from this card and is used just to confirm booking. Your card data will be deleted entirely and is not stored after the date of your booked appointment.
    3.3 You have the following rights to cancel any booking:
    a) subject to the cancellation charges set out below, you may cancel any booking at any time prior to the booking;
    b) if you cancel a booking and you have made any payment in advance for treatments that have not been provided to you, we will refund the representative amounts.
    3.4 If you cancel a booking for a treatment you will be responsible for the following cancellation fee:
    a) where the cancellation is more than 48 hours before the booked time for the treatment, there will be no cancellation fee.
    b) where the cancellation is 48 hours or less before the booked time for the treatment, you will be responsible for a consultation fee of £25.
    3.5 If we have to cancel a booking due to an event beyond our reasonable control, an unavailability of key personnel or products/materials, without which we cannot provide the treatments, we will contact you as timely as possible. Last minute cancellations by the company may very rarely occur due to clinical reasons. If you have made any payment in advance, we will provide a full refund.
  1. OUR LIABILITY TO YOU
    4.1 As a consumer, you have legal rights in relation to treatments not carried out with reasonable technique and care, or if any products we use are faulty or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Our terms and conditions will not affect your legal rights.
    4.2 We only supply products for private use. You agree not to use the products for any commercial, business or re-sale purpose. We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity as long as good clinical practice (as outlined in item 2.5) has been upheld.
    4.3 We do not exclude or limit in any way our liability for:
    a) death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors;
    b) fraud or fraudulent misrepresentation;
    c) breach of the terms implied by section 12 of the Sale of Goods Act 1979 and by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession);
    d) breach of the terms implied by sections 13, 14 and 15 of the Sale of Goods Act 1979 and sections 3, 4 and 5 of the Supply of Goods and Services Act 1982 (description, satisfactory quality, fitness for purpose and samples); or
    e) defective products under the Consumer Protection Act 1987.
    4.4 We will not have any liability to you if loss, injury or damage occurs as a result of a failure to provide information (medical or otherwise), or as a result of the supply of inaccurate or incomplete information at any stage of the consultation or treatment process.
  1. YOUR PERSONAL INFORMATION
    We will handle personal information you provide in accordance with our Privacy Policy. Your personal details will never be passed to any third parties, but may be used for our own marketing purposes for relevant products, treatments or services. You may contact us and opt out of this at anytime.

7. LICENSE TO USE THE WEBSITE

Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website. Subject to the licence below, all these intellectual property rights are reserved. You may view, download for caching purposes only, and print pages from the website for your own personal use, subject to the restrictions set out below and elsewhere in these terms of use. You must not:

a) republish material from this website (including republication on another website);

b) sell, rent or sub-license material from the website;

c) show any material from the website in public for commercial purposes;

d) reproduce, duplicate, copy or otherwise exploit material on our website for a commercial purpose;

e) edit or otherwise modify any material on the website; or

f) redistribute material from this website except for the "Skin 101" page and its sub-pages.

 

8. FREE GIFTS, OFFERS AND DISCOUNTS

8.1 Free gifts where advertised are one per customer. Applies only to the customer's first consultation at the Clinic.

8.2 The gift advertised may change and will be given at the discretion of the the Clinic. The Clinic's Director, surgeon or manager may withhold a free gift, offer or discount, and the gift may change at any time without notice.

8.3 Offers are limited and are subject to availability.

8.4 Where offers are relating to qualifying social media involvement, the customer must be able to demonstrate their involvement, post, share or 'like' at the time of consultation to qualify for the free product.
